Lousso Designs Disclaimers

  1. Reupholstery Old Cover Removal: With respect to items to be reupholstered, old covers will be removed and will be discarded unless Customer advises Lousso Designs in writing to return the old cover prior to initiating the project. This must be included within the scope of the work order.

  2. Client-Supplied Material: Lousso Designs is not responsible for the quality, suitability, or durability of materials supplied by the Customer.

  3. Design and Fabric Suitability: The Customer is responsible for ensuring that the selected design and fabric are suitable for their intended use. Lousso Designs can provide recommendations but is not liable for unsatisfactory results due to unsuitable choices.

  4. Project Timeline: Estimated project timelines are provided as guidelines and are subject to change based on various factors. Lousso Designs is not liable for any damages or losses resulting from delays beyond the estimated completion date.

  5. Design Changes: Any changes to the design or specifications after the work order has been finalized may incur additional charges, starting at 5% of the labor cost, and could result in project delays.

  6. Upholstery Patterns: Pattern alignment and placement will be done to the best of our ability. Due to fabric characteristics, some pattern alignment discrepancies may occur and are considered normal.

  7. Pre-Existing Condition: Lousso Designs is not responsible for pre-existing conditions in the Customer’s furniture that may affect the final outcome. We recommend full disclosure of any issues before work begins.

  8. Client Communication: Lousso Designs relies on electronic communication for project updates and approvals. Timely communication from the Customer is essential to avoid delays. It is the Customer’s responsibility to ensure they are reachable via the provided contact methods. Lousso Designs is not responsible for delays caused by lack of Customer response.

  9. Upholstery Customization: Custom upholstery projects are tailored to Customer specifications. Any changes after production has started may incur additional costs and affect the delivery timeline.

  10. Fabric Direction: Unless specified by the Customer, the direction of fabric (e.g., nap, pattern) will be at the discretion of Lousso Designs to best fit the upholstery piece.

  11. Fit and Tolerance: Upholstered items are crafted to fit specified dimensions within a tolerance range of +/- 1 inch. For products such as cushions and soft upholstery, variations may range from 2 to 4 inches due to their flexible and amorphous nature. Slight variations in fit are normal and to be expected due to the nature of handmade items.

  12. Seam Placement: All seam placement must be clarified upon work order finalization. If not specified, seams will be placed at the discretion of Lousso Designs.

  13. Fabric Quantity: Lousso Designs strives to quote fabric quantities accurately. However, each piece is unique, and exact requirements aren’t known until the piece is in our hands. We provide a range for Customers to order within. If the smaller quantity is chosen and more fabric is needed, it will delay project completion. We will promptly inform the Customer if additional material is required, and it is the Customer’s responsibility to supply the extra fabric.

  14. Comfort Disclaimer: Comfort preferences are subjective and can vary widely. Lousso Designs cannot guarantee that the level of comfort will meet all individual preferences. If a Customer has specific requests, they must be clearly communicated on the work order in a measurable and achievable way (e.g., specify soft density foam rather than just “soft”).

  15. Unforeseen Issues: Unforeseen issues may arise during the upholstery process. Lousso Designs will communicate any additional work or costs required to address these issues.

  16. Pillow and Cushion Inserts: Lousso Designs is not liable for any dissatisfaction with pillow and cushion inserts if they match the specifications on the work order. Customers are encouraged to request samples of our various insert types to make an informed decision.

  17. Foam Utilized in Upholstery and Custom Furniture: Lousso Designs is not liable for any dissatisfaction with foam density if it matches the specifications on the work order. Customers are encouraged to request samples of our various foam densities to make an informed decision.

  18. Measurements: Lousso Designs is not responsible for any inaccuracies in measurements that we have not taken ourselves. Customers are advised to ensure that measurements provided are accurate.

  19. Floor and Wall Level Assumptions: Our pieces are crafted assuming level floors and straight, even walls. Discrepancies may affect stability and fit. Ensure your floors and walls are level before installation. Lousso Designs is not responsible for issues arising from uneven floors or walls.

  20. Installation Estimates: Lousso Designs strives to provide accurate installation time estimates. However, each project is unique, and exact installation requirements may not be fully understood until the work is in progress. We provide a range of estimated installation times for Customers to plan within. If additional time is needed beyond the initial estimate, we will promptly inform the Customer, and it is the Customer’s responsibility to accommodate and cover the extended schedule and associated costs.

  21. Third Party Clients: By signing this document, you acknowledge and accept full responsibility for this project as the direct Customer of Lousso Designs. Lousso Designs is solely responsible for producing the products as agreed upon in our correspondences. Any miscommunications or discrepancies between you and any third-party client that do not fall within the communicated scope of this project are not the responsibility of Lousso Designs to remedy. This includes any additional requirements, changes, or expectations not explicitly outlined in our agreement.

  22. Artisan Work: By purchasing services and products from Lousso Designs, the Customer acknowledges and accepts that Lousso Designs is comprised of a team of artisans producing unique, handcrafted pieces. Every stitch, corner, groove, and detail requires the meticulous touch of seasoned craftsmen. All lead times provided, other than for rush orders, are estimates. Given the one-of-a-kind nature of each piece, Lousso Designs does not assume liability for any damages or losses resulting from delays in production. We take pride in our work, and rushing limits our ability to perform to our highest standard. Therefore, Lousso Designs will not compromise the quality of its products for the sake of expediting project turnaround. By proceeding with our services, Customers accept that any requests to expedite production will be respectfully declined in the interest of maintaining our high standards.

  23. Straight Lines and Perfect Consistency: While we aim to achieve perfect symmetry and balance in all our products, it is important to note that each item is handcrafted. Customers understand and expect that some minor imperfections may be present due to the handmade nature of the products.

  24. Client Approval: Before authorizing pick-up or delivery, all orders must receive Customer approval. Our team will provide final photos of the completed work for your review. If you would like more photos, a personal video call, or an in-person inspection, please inform us, and we will arrange it. Customer approval of the work is required before scheduling pick-up or delivery. Additionally, a Proof of Delivery must be signed to verify that the order was delivered without damage.

  25. Details Omitted from Work Order: Lousso Designs is not responsible for any details omitted from the Work Order.

  26. Remaining Fabric: Any additional fabric not used in completion of the project will be moved into Lousso storage and taken under the possession of Lousso Designs unless Customer advises Lousso Designs in writing to return the remaining fabric within 5 days of completion.

  27. Discretion on Unspecified Details: Any details not specified by the Customer and explicitly included in the Statement of Work will be completed at the discretion of Lousso Designs.

  28. Rights to Photographs and Videos: Customer grants Lousso Designs the right to photograph and record video of all items listed in the Statement of Work. Customer also grants Lousso Designs the irrevocable and unrestricted right to reproduce photographs and/or video images taken of the aforementioned items for the purpose of publication, illustration, advertising, promotion, trade, or website development, in any manner or in any medium. Customer hereby releases Lousso Designs and its legal representatives for all claims and liability relating to said images or video.

  29. Storage Fee: A storage fee applies to work not removed from Lousso Designs’ premises by Customer within 15 days after notice of completion. Rates are at the discretion of Lousso Designs, starting at $100 per month per item.

  30. Rush Order Surcharge: Rush orders are subject to a surcharge at the discretion of Lousso Designs.

  31. Site Readiness Disclaimer: When Lousso Designs conducts a measurement for your custom furniture, it is essential that the space is in its final stage of completion. This includes the completion of all pieces such as drywalls, window sills, outlets and any fixed components our products might be attached to. Additionally, Customers must inform us of any elements that may affect the dimensions of the products we are providing, including but not limited to: Moldings, Floor dimensions, Vents, Any required electrical access, Lighting fixtures, Artwork, Shelves or wall fixtures, and any required Storage access. Failure to ensure the completion of these elements or to inform us of these details may impact the accuracy of measurements and the final fit of the custom pieces. Lousso Designs is not responsible for any discrepancies or issues arising from an incomplete or inaccurately reported site condition. By proceeding with a measurement appointment, the Customer acknowledges and accepts responsibility for ensuring the site is prepared and all relevant details are communicated.

  32. Custom Furniture Timeline Disclaimer: Creating custom furniture is a multi-phase process, each with its own timeline. While we strive to complete each project as efficiently as possible, the following timelines are estimates and may change due to various factors beyond our control.

    1. Initial Design Phase (1-3 weeks): This phase involves confirming design details and approving fabrics and finishes. It typically takes 1-3 weeks from the time the deposit is paid. Delays in receiving materials or approvals may extend this phase.

    2. Drawing Phase (4-6 weeks): Our designers will create detailed drawings of the custom piece to assist with manufacturing and to provide a clear visualization of the final product. This phase usually takes 4-6 weeks but can be shorter if there are minimal revisions.

    3. Production Phase (10-12 weeks): Once the drawings are approved, the project moves into the production phase. This timeline assumes that all fabrics and special materials arrive on time and that there are no unexpected issues during production. Delays in material shipments, production challenges, or unforeseen circumstances can extend this phase.

    4. Overall Timeline (16-18 weeks): Combining all phases, the total estimated timeline for creating custom furniture is typically between 16-18 weeks from first contact to completion. Please note that these timelines are estimates and may vary based on project complexity, material availability, and other factors.

      • By proceeding with a custom furniture order, the Customer acknowledges and accepts these timelines and the potential for delays. Lousso Designs is committed to delivering high-quality, handcrafted pieces and will take all necessary steps to ensure the project is completed to the highest standards.

  33. Fabric Suitability Disclaimer: At Lousso Designs, we strive to provide the highest quality craftsmanship in all our upholstery projects. However, the choice of fabric significantly impacts the outcome and durability of the finished piece. The Customer is responsible for selecting appropriate materials for their specific needs and preferences. Lousso Designs is not liable for any issues arising from unsuitable fabric choices, including but not limited to:

  • Easily Imprintable Velvets and Mohairs: These fabrics can easily show pressure marks and imprints.

  • Embroidered Fabrics: These can be difficult to work with, often requiring special handling to avoid damage to the embroidery.

  • Woven and Embroidered Fabrics: These may fray easily when cut, stretched, or upholstered. If we receive these, we may request a new material be provided, which will delay the completion of the project.

  • Fabrics with Insufficient Stretch: Materials that do not have enough give to allow for proper upholstery around rounded edges can result in a poor fit and appearance.

  • Delicate or Thin Fabrics: These can be prone to tearing or wearing out quickly under normal use.

  • Stiff or Rigid Fabrics: These may not conform well to the shape of the furniture, leading to an unsatisfactory finish.

  • Light-Colored or Easily Stained Fabrics: These can show dirt and stains more readily, requiring more frequent cleaning and maintenance.

  • Heat-Sensitive Fabrics: Materials that can be damaged by heat during the upholstery process.

  • Fabrics with Odors: Some fabrics may arrive with odors from the manufacturers.

  • High Sheen or Wrinkle-Prone Fabrics: Fabrics with a high sheen or those that show wrinkles easily are not suitable for loose cushions, upholstery, and slipcovers as they will accentuate all wrinkles.

  • Handcrafted Nature: Customers should be made aware that our artisans work with their hands to upholster goods, and some fabrics may be too delicate to be applied to hand-crafted pieces like ours.

By proceeding with your fabric selection, you acknowledge and accept that Lousso Designs is not responsible for any issues resulting from the use of unsuitable fabrics. We highly recommend consulting with our team to ensure the best fabric choice for your project. However, even with our consultation, we cannot predict every possible outcome. Ensuring that a fabric is the correct choice for the project is ultimately the Customer’s responsibility. Lousso Designs is not liable for damages or losses caused by poor fabric choice.
